Amerdeco cannot and will not be liable for any loss or damage from your failure to protect your account password.

You acknowledge and agree that Amerdeco shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, events, goods, or services available on or through any such third-party websites. We strongly advise you to read the terms and conditions and privacy policies of any third-party website that you visit.

Section 1.5 – Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Site will cease immediately. We will not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.

Amerdeco and yourself irrevocably consent that the courts of the State of California shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice through the Site or by other means prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Section 2 – General Conditions

Section 2.1 – Accuracy of Information

We attempt to ensure that information on this Site is complete, accurate, and current. Despite our efforts, the information on this Site may occasionally be inaccurate, incomplete, or out of date. We make no representation as to the completeness, accuracy, or currency of any information on this Site. For example, products included on the Site may be unavailable, may have different attributes than those listed, or may actually carry a different price than that stated on the Site.

Section 2.2 – Typographical Errors

In the event a product is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged.

Section 2.3 – Modifications to Prices and Products

Prices and availability of products are subject to change without notice. We reserve the right at any time to modify or discontinue offers without notice at any time. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of any product or offer.

Section 2.4 – Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, per order, or per any other metric. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate billing and account information for all purchases made via the Site. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

Section 2.5 – Sales Tax

If you purchase any products on the Site, applicable sales tax will be collected based on your delivery address and the sales tax rate in effect at the time you purchase the product.

Section 2.6 – Risk of Loss

Products purchased from Amerdeco are shipped Free On Board Shipping Point (FOB Shipping Point). This means that Amerdeco fulfills its obligation to deliver when the products are delivered to the carrier at Amerdeco’s shipping location. Title of goods and risk of loss transfer to the customer when the products are delivered to the carrier. Shipping and delivery dates are estimates only and cannot be guaranteed. Amerdeco is not liable for any delays in shipments.

Section 2.7 – Returns, Refunds, and Title

Amerdeco accepts product returns in accordance with our Return Policy posted on our Site.

Please review our Return Policy prior to making any purchases. Customers are responsible for return shipping costs unless the return is due to our error. Refunds are generally processed within 3-5 business days after receipt of the returned item.

Title to products purchased on our Site pass to you when the product ships from our warehouse.

Section 3 – Product-Specific Conditions

Section 3.1 – Custom Cabinet Pulls

Amerdeco offers fully customizable cabinet pulls where you can choose the shape, size, finish, hole centers, and other options to create pulls tailored to your needs.

For custom pulls, we will provide you with a design proof for your approval prior to manufacturing. You agree to review proofs carefully to ensure all details are correct. We are not responsible for errors or defects in custom products created according to your approved design.

Once a custom order has been placed, it cannot be cancelled or returned.

Section 3.2 – Care Instructions

It is important to care for your cabinet hardware properly to preserve the finish. We recommend cleaning with a soft cloth and mild soap and water. Avoid harsh detergents or chemicals. For stubborn dirt, you can use a specialized metal cleaner. Use care when cleaning to avoid scratching the surface.

Avoid exposing the hardware to moisture for prolonged periods. Immediately dry any water exposure.

Use care when installing to avoid scratching or damaging the finish. We recommend using a soft cloth between the hardware and your tools during installation.

Section 3.3 – Use of Products

Products are intended for interior decorative use only. They are not intended for commercial use or installation in areas with special structural requirements. Customers are advised to consult with a professional if uncertain about installation methods or requirements. Improper installation may result in damage to property.

Amerdeco is not liable for any damage or injury resulting from the use or installation of any products purchased on our Site.

Section 4 – Use of Site and Content

Section 4.1 – Site Use

You are granted a limited, revocable, and nonexclusive right to access and use the Site and its content and services for your personal use only, provided that you comply fully with these Terms. You may not use this Site or its content for commercial purposes without our written permission.

The Site may contain robot exclusion headers. You agree that you will not use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.

Additionally, you agree that you will not:

• Use any meta tags or any other “hidden text” utilizing our name or trademarks without our express written permission;
• Use any device, software, or routine that interferes with the proper working of the Site, or otherwise attempt to interfere with the proper working of the Site;
• Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful;
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site;
• Attack the Site via a denial-of-service attack or a distributed denial-of-service attack;

Such notice must include the following information: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing or the subject of infringing activity; (d) the name, address, telephone number, and email address of the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and (f) a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who repeatedly violate our copyright policies and/or are repeat infringers of copyrights.

You agree that Amerdeco may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Site.

We may use this information, as long as it is collected anonymously in a form that does not personally identify you, to improve our products or provide services or technologies.

Section 4.6 – Children

The Site is not intended for individuals under the age of 18. We do not intentionally gather personal data about visitors who are under the age of 18. If a child under 18 submits personal data to Amerdeco and we learn that the personal data is the information of a child under 18, we will attempt to delete the information as soon as possible. You agree to defend, indemnify, and hold Amerdeco harmless from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with any of the following: (a) your access to or use of the Site or products obtained through the Site; (b) your breach or alleged breach of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, publicity or privacy right; or (d) any misrepresentation made by you. You will cooperate as fully required by us in the defense of any claim. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you will not in any event settle any claim without our prior written consent.

Under no circumstances shall we be liable to you for any indirect, incidental, consequential, special, or punitive damages or lost profits, even if Amerdeco has been advised of the possibility of such damages.

Section 5.3 – Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, related parties, officers, directors, employees, agents, independent contractors, advertisers, partners, and co-branders, from and against all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of and access to the Site; (b) any violation by you of any term of these Terms; (c) any third party claim that your User Content caused damage to a third party. These Terms constitute the entire agreement between you and Amerdeco with respect to your use of the Site. These Terms supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
